Public offer

1. Terms and Definitions

Seller, online store Budlea — Sole Proprietor BROVCHENKO-SPYTSYNA SVITLANA VASYLIVNA, established in accordance with the legislation of Ukraine, carrying out the sale of Goods by remote means, including via the information and telecommunication network “Internet” through the Online Store at: Budlea.com.ua.

User — an individual who uses the Website services and individual Website functions.

Buyer — a citizen who intends to purchase Goods exclusively for personal, family, household, and other needs not related to entrepreneurial activity.

Remote sale of Goods — the sale of Goods under a retail sale agreement concluded based on the Buyer’s review of the description of the Goods offered by the Seller, as well as payment, delivery, and warranty terms contained on the Online Store website.
In accordance with Part 6 of Article 11 of the Law of Ukraine “On Electronic Commerce,” the retail sale agreement is considered concluded at the moment the Buyer completes the order placement procedure — the Buyer’s acceptance of this Public Offer and agreement to its terms.

Confirmation of the conclusion of the retail sale agreement is the issuance by the Seller to the Buyer of a fiscal receipt, sales receipt, or other document confirming payment for the Goods.

Online Store — a resource owned by the Seller, located on the Internet at: Budlea.com.ua, where Goods offered for purchase are presented, along with information necessary for making a purchase, including price, payment and delivery methods and conditions, and pickup addresses.

Online Store Website — a set of logically interconnected web pages owned and administered by the Online Store, containing information about the Goods and conditions of their purchase at: Budlea.com.ua.

Personal Account — the User’s personal space, a personalized Website interface with user tools for accessing personalized Website services.

Order — an electronic or verbal request/application by the Buyer to purchase Goods from the Online Store assortment under the terms of this Public Offer.

Goods — products, information about which is posted on the Website.

Services — a set of measures carried out by the Online Store in relation to the Buyer to fulfill the retail sale agreement, including but not limited to delivery of the Order, informing the Buyer about the performance process, etc.


2. General Provisions

Information posted in the Online Store at Budlea.com.ua contains the terms of the offer to purchase Goods and constitutes a Public Offer in accordance with Part 2 of Article 11 of the Law of Ukraine “On Electronic Commerce” and Articles 641–643 of the Civil Code of Ukraine.

This Public Offer is an official proposal of the Seller addressed to an indefinite number of persons to conclude a retail sale agreement with a Buyer who has placed an Order.

An Order is considered placed and submitted to the Seller at the moment the Order placement procedure is completed in the Online Store. Completion of the Order placement procedure constitutes the Buyer’s acceptance of the Public Offer.

This Public Offer may be amended by the Seller without special notice to the Buyer/User. The new version enters into force upon publication on the Website and does not apply to legal relations that arose before its publication, unless otherwise provided.

The Online Store operates in accordance with the Civil Code of Ukraine, the Law of Ukraine “On Consumer Protection,” the Law of Ukraine “On Electronic Commerce,” the “Rules for Sale of Goods by Order and Outside Commercial or Office Premises,” and other applicable regulations of Ukraine.

The Buyer and Seller guarantee that they possess the necessary legal capacity and authority to conclude and perform this Offer and retail sale agreement. Each party is responsible for the accuracy of the information provided.

The Online Store is not responsible for the accuracy of information provided by the User/Buyer during registration or order placement. The Buyer is responsible for the validity and relevance of the provided data.


3. Goods and Purchase Procedure

All textual information and graphic images on the Website are the property of the Online Store.

Goods presented in the Online Store have all required certificates in cases предусмотренных legislation of Ukraine and comply with applicable standards.

Product photos are illustrative and may differ from the actual appearance. Screen settings may distort colors. The manufacturer may change product characteristics without prior notice.

The Buyer may contact customer support for additional product information. Upon request, the Seller must provide necessary and sufficient information by phone or email.

Each product is accompanied by information about its main characteristics, Seller’s address, place of manufacture, price, purchase conditions, service life/shelf life, and warranty period.

Product availability is determined by the status shown on the product page.

Prices are indicated in Ukrainian hryvnias (UAH). Sales are conducted in real time (24/7), and price/availability may change without prior notice. A product is reserved only after order processing.

The final price may be reduced through discounts, bonuses, or promotions according to the Seller’s program.

Orders may be placed by registered or unregistered Users.

A User may register only once and have only one Personal Account per email address.

Users receive login and password credentials. They must provide accurate registration data and keep it up to date. The Seller may block/delete accounts with inaccurate information.

Personal data is stored and processed according to the agreement terms.

Orders may be placed:

  • by adding Goods to the cart and completing the order form;

  • by calling 0800400212.

Where technically possible, SMS notifications regarding order status may be provided.

If ordered Goods are unavailable, the Seller may remove them from the Order and notify the Buyer. In case of prepaid orders, the refunded amount will be returned via the original payment method.


4. Delivery or Receipt of Goods

The Seller provides delivery services. Methods, terms, and cost are specified in the “Delivery and Payment” section.

Delivery cost is calculated individually. The final Order amount is communicated via SMS and/or displayed in the Personal Account.

Delivery is limited to the territory of Ukraine, excluding temporarily occupied territories, including Crimea.

The Seller may engage third parties for delivery while remaining responsible for proper performance.

The Order is delivered to the Buyer or a designated Recipient.

Upon delivery of prepaid Orders, the courier may request identification.

The Recipient must inspect the Goods upon receipt. Risk of accidental loss or damage transfers upon signing delivery documents.

Courier waiting time is limited to 15 minutes after notification of arrival.

If delivery is performed by a postal service, responsibility for shipment safety and timing transfers to the selected postal service upon dispatch.


5. Payment

Payment may be made in cash upon receipt or by bank card.

Card payments are carried out by the cardholder or authorized person. Banks perform authorization and may refuse suspicious transactions. Fraudulent transactions fall under the Criminal Code of Ukraine.

For prepaid Orders, the Seller sends an electronic receipt to the Buyer’s email address.


6. Refusal, Return, and Refund

The Buyer may refuse the Goods before transfer, and after transfer according to the “Exchange and Return” section.

Returns of goods of proper quality are governed by the “Exchange and Return” section.

Upon postal receipt, the Buyer must inspect packaging integrity. Damage must be documented with postal staff.

If the Buyer refuses to receive the Goods, the Seller refunds the amount paid minus delivery/return costs within 10 days.

Refunds are made using the original payment method.


7. Confidentiality and Data Protection

Personal data is processed in accordance with the Law of Ukraine “On Personal Data Protection.”

Upon registration, Users provide name, phone number, email, and delivery address. Additional data is optional.

The Seller implements sufficient organizational and technical measures to protect personal data.

By providing personal data, the User/Buyer consents to its processing.

The Seller may use cookies and collect IP addresses. This information is not used to identify visitors and is not transferred to third parties.

The Seller may record telephone conversations and undertakes to prevent unauthorized access.


8. Validity of the Public Offer

This Public Offer enters into force upon acceptance by the Buyer and remains valid until both parties fulfill their obligations.


9. Additional Terms

The Seller may assign its rights and obligations to third parties without additional consent.

The Online Store services may be temporarily unavailable for technical reasons.

Ukrainian law applies to relations between the parties.

Disputes shall first be resolved through negotiations, and failing agreement — in accordance with Ukrainian legislation.

Invalidity of any provision does not invalidate the rest.

Changes to this Offer or product descriptions may be made without prior notice.

The most current rules are published on the Website.

Notification of changes is made via news posted on the Website.
